Car Rental Terms and Conditions

Welcome to Xiao Qiang Holidays (XQ) Sdn. Bhd!
Our car rental service offers a convenient and reliable way to explore Langkawi Island, Malaysia. Please carefully read the following terms and conditions, which outline important details about booking, rental periods, insurance coverage, and more. By renting a vehicle through our website or by signing a contract, you agree to adhere to these terms.

1. General Information

  • The vehicle is the property of XQ and is delivered in good mechanical condition. The Renter shall drive and maintain the vehicle cautiously and prudently. The vehicle, including tires, spare wheel, jack, and other supplementary accessories, must be returned in the same condition as received, excluding ordinary wear and tear.

  • The vehicle must be returned in the same level of cleanliness as it was delivered. If the vehicle is returned excessively dirty, a cleaning fee of RM30 (minimum) will be charged.

  • Driver's License and Age Qualifications: Drivers must be between 23 and 65 years old. XQ recognizes all valid Malaysian Driving Licenses, International Driving Licenses (IDL), and International Driving Permits (IDP) or official translations in English. Drivers must have held a valid license for at least one year. Provision or newly qualified drivers are strictly prohibited from driving XQ vehicles.

  • Identification: Valid identification (ID card or passport) is required upon vehicle pick-up.

2. Rental Charges

  • Daily, Weekly, and Monthly Rates: Rental charges are calculated based on a 24-hour period for daily rentals. Weekly rates apply to rentals lasting 7 or more days, while monthly rates apply to rentals of 30 days or more. If the rental period exceeds 14 days, a monthly rate may apply if it offers a better rate.

  • Seasonal Pricing: All rental costs are based on our seasonal pricing structure, which may vary depending on demand, vehicle availability, and time of year. For up-to-date seasonal rates, please contact our customer support.

  • Prorated Extensions: For monthly rentals, extensions beyond the original rental period will be calculated on a prorated basis.

  • Late Returns: If the vehicle is returned more than 30 minutes after the agreed return time, an additional daily rental charge may apply.

  • Extra Hourly Fees: If the vehicle is returned late but within the same day, an extra hourly fee will be calculated and billed during the order process. The exact hourly fee will be displayed during the checkout process on our website. The extra fees are based on the Company’s internal calculation and will be charged automatically during payment.

3. Protections & Coverages

  • Third-Party Liability Insurance: Provides unlimited liability coverage for injury or death to third parties, with up to RM3 million for property damage.

  • Collision Damage Waiver (CDW): Limits the Renter’s liability for vehicle damage. The Renter is still responsible for an excess amount ranging from RM500 to RM2,000 depending on the vehicle group. Note: CDW does not cover windscreens, tires, undercarriage, replacement locks, replacement keys, or towing charges.

  • Collision Damage Reduction (CDR) Policy: This covers accidental damage to third-party property and bodily injuries. However, in line with commercial insurance practices, the Renter is responsible for an excess clause based on the vehicle type:

  • Sedan/Hatchback: RM3,000

  • MPV/Van/SUV: RM6,000

  • Luxury Car: RM10,000

  • Theft Protection (TP): Limits liability for theft, with an excess ranging from RM500 to RM2,000 depending on the vehicle group.

  • Windscreen Protection (WP): Available at RM5 per day or RM50 per month, reducing liability for windscreen damage to the stated maximum excess amount.

  • Super Coverage Package: Available for RM30 per day or RM300 per month, reducing CDW, TP, and WP excesses to zero.

  • Personal Accident Insurance (PAI): Optional coverage at RM6 per day or RM180 per month, providing up to RM100,000 for the Renter and RM20,000 per passenger.

  • Accident and Damage Reporting: The Renter must inform XQ of any damages incurred to the vehicle. No repairs or changes to the vehicle are allowed without XQ's consent. Failure to report or unauthorized repairs may result in the forfeiture of the security deposit.

4. Roadside Assistance

  • Complimentary Assistance: Xiao Qiang Holidays Sdn. Bhd. (XQ) provides complimentary 24-hour roadside assistance for mechanical breakdowns, tire changes, battery jumps, and towing within Langkawi Island. For assistance, please contact 1800-XX-XXXX.

  • Limitations: Roadside assistance is limited to mechanical or technical failures that occur under normal use. XQ will not provide assistance for incidents arising from the Renter's negligence, misuse, or violation of the rental terms, including but not limited to:

  • Running out of fuel.

  • Locking keys inside the vehicle.

  • Using the wrong fuel type.

  • Responsibility: In the event of a breakdown due to the Renter’s negligence or violation of the rental terms, the Renter will be responsible for all costs incurred for towing, repairs, and any replacement vehicle.

5. Full Maintenance

  • Routine Maintenance: During the rental period, XQ is responsible for the vehicle's routine maintenance and servicing, in line with manufacturer recommendations. This includes oil changes, brake checks, tire rotations, and other standard maintenance procedures.

  • Renter's Responsibilities: The Renter is required to operate the vehicle responsibly and report any warning lights, unusual noises, or mechanical issues immediately to XQ. Failure to report such issues promptly may result in the Renter being held liable for any resulting damage.

  • Prohibited Actions: The Renter is not permitted to perform or authorize any repairs or maintenance on the vehicle. Any unauthorized repairs may result in the forfeiture of the security deposit and additional charges for restoring the vehicle to its original condition.

6. Items Not Covered

  • Cleaning Fees: The vehicle must be returned in the same level of cleanliness as when it was rented. If the vehicle is returned in an excessively dirty condition, a cleaning fee of RM30 (minimum) will be charged to the Renter.

  • Loss or Damage to Accessories: The Renter is responsible for any loss, theft, or damage to vehicle accessories, including but not limited to:

  • GPS devices.

  • Child/Toddler safety seats.

  • Vehicle keys, spare tires, jacks, or other equipment. The cost of lost or damaged accessories will be determined based on market replacement value and deducted from the security deposit if applicable.

  • Personal Belongings: XQ is not liable for the theft, loss, or damage of any personal belongings left in the vehicle during the rental period. The Renter is advised to remove all valuables when leaving the vehicle unattended.

7. Vehicle Delivery and Collection

  • Pick-Up and Return Location: Vehicles must be picked up and returned to the designated XQ location unless prior arrangements for delivery and collection services are made.

  • Delivery and Collection Services: Delivery and collection services are available upon request and are subject to additional charges based on distance and availability. The specific fees will be provided at the time of booking.

  • Surcharge for Non-Operating Hours: A surcharge applies for vehicle pick-up or return outside regular business hours or on public holidays. The surcharge amount will be communicated during the booking process and must be paid at the time of the transaction.

  • Condition at Return: The Renter is responsible for returning the vehicle in the same condition as it was delivered, with all original accessories and equipment. XQ reserves the right to inspect the vehicle upon return and charge for any damages, missing items, or required cleaning.

8. Where Vehicle May Be Used

  • Permitted Use Area: The vehicle is strictly permitted for use within Langkawi Island only. The Renter must not drive or transport the vehicle outside of Langkawi Island without prior written consent from XQ. Unauthorized use outside of Langkawi will result in the immediate termination of the rental agreement, and the Renter will be fully liable for all recovery costs, damages, and legal consequences.

  • Prohibited Uses: The vehicle must not be used for:

  • Off-road driving or driving on non-gazetted roads.

  • Racing, speed tests, or any competitive events.

  • Towing or pushing other vehicles or trailers.

  • Transporting illegal substances, hazardous materials, or for any illegal activity.

  • Violation of Use Restrictions: Any violation of these use restrictions may result in immediate termination of the rental agreement, forfeiture of the security deposit, and additional charges for any damages or penalties incurred.

9. Rental Extensions

  • Advance Arrangements: Any extension of the rental period must be arranged and approved in advance with Xiao Qiang Holidays Sdn. Bhd. (XQ). The Renter must contact XQ to request an extension before the agreed return date and time. Extensions are subject to vehicle availability and the payment of additional rental charges.

  • Payment for Extensions: If an extension is approved, the additional rental charges will be calculated based on the current rates and must be paid immediately. Failure to pay the extension charges on time may result in the termination of the rental agreement.

  • Unauthorized Extensions: If the Renter fails to arrange an extension in advance and does not return the vehicle by the agreed return date and time, this will be considered an unauthorized extension. In such cases:

  • The Renter will be charged an additional fee equivalent to the daily rental rate for each day the vehicle is not returned.

  • The Renter may be driving the vehicle without appropriate insurance coverage, as insurance may lapse without a valid extension.

  • XQ reserves the right to take legal action to recover the vehicle and any associated costs.

  • Liability During Extensions: During an authorized extension, all terms and conditions of this agreement, including liability and coverage, remain in effect. However, during an unauthorized extension, the Renter assumes full liability for any damages, losses, or fines incurred, and XQ will not be held responsible for any incidents occurring during this period.

10. Fuel Policy

  • Fuel Specification: The Renter is responsible for ensuring that the correct fuel type is used for the vehicle as per the car’s specifications. Information about the required fuel type is available on a label located on the inside of the fuel door or near the fuel filler neck. Additional information can also be found in the vehicle’s manual, which is provided in the car. If the Renter is uncertain about the appropriate fuel type, they must contact Xiao Qiang Holidays Sdn. Bhd. (XQ) for assistance and clarification.

  • Full to Full: The vehicle is supplied with a full tank of fuel and must be returned with a full tank. The Renter is responsible for refueling the vehicle to the same level before returning it.

  • Level to Level: If the vehicle is not returned with a full tank, a refueling surcharge will be applied based on the amount of fuel required to refill the tank to its original level.

  • Incorrect Fuel Use: The Renter is liable for any damages, repairs, or costs resulting from using an incorrect fuel type. XQ is not responsible for any damage caused by the Renter’s failure to use the correct fuel.

11. Optional Accessories

  • GPS Devices: GPS devices will not be provided separately unless the vehicle is equipped with a built-in GPS system. For vehicles with a built-in GPS, no additional charges will apply. The Renter is responsible for using the GPS device in accordance with the vehicle's manual and is liable for any damages to the system due to misuse or negligence.

  • Child/Toddler Safety Seats: Child safety seats are available at RM10 per day or RM100 per month.

  • Responsibility: The Renter is fully responsible for the proper installation and use of the baby car seat. It is the Renter’s duty to inspect the seat for any damage or malfunction before each use. If any issues with the baby car seat are noticed, the Renter must report it immediately to Xiao Qiang Holidays Sdn. Bhd. (XQ) or seek assistance regarding its functionality and proper use.

  • Liability: XQ is not responsible for any injury or damage resulting from the improper use, installation, or malfunction of the child safety seat if not reported to the company in advance.

  • Damages and Loss: The Renter will be charged for any loss, theft, or damage to the child safety seat during the rental period. The charges for lost or damaged accessories will be determined based on the market replacement cost.

  • Accessories Use and Liability: The Renter agrees to use all optional accessories (GPS devices, child safety seats) safely and in accordance with the vehicle and accessory manuals. Any misuse or negligence in handling these accessories resulting in damage, loss, or injury is the sole responsibility of the Renter.

12. Security Deposit & Late Payment Charges

  • Security Deposit: A refundable security deposit is required at the time of booking. The amount of the deposit depends on the vehicle class and will be specified during the checkout process. The deposit serves as partial security for any potential damages, fines, or additional charges incurred during the rental period.

  • Refund Process: The deposit will be refunded within 7 days after the vehicle is returned and successfully inspected, provided there are no damages, violations, or outstanding charges. If damages, violations, or extra fees are identified, the cost will be deducted from the deposit, and the remaining balance (if any) will be refunded to the Renter.

  • Forfeiture: The deposit may be forfeited in cases of significant vehicle damage, unauthorized repairs, breach of the rental agreement, or use of the vehicle for illegal activities.

  • Payment of Charges: The Renter is required to pay the rental charges, security deposit, and any other additional fees (such as accessories or insurance) at the time of booking. All payments must be made using the accepted payment methods as specified on the website.

  • Late Payment Charges: In cases where additional charges (e.g., late return fees, fines, damages) are incurred and remain unpaid by the Renter:

  • An interest charge of 18% per annum, calculated daily, will apply to the outstanding amount.

  • XQ reserves the right to charge the Renter’s credit card on file or deduct the charges from the security deposit to cover any unpaid fees.

  • Failure to settle outstanding payments may result in legal action, and the Renter will be liable for all costs associated with the recovery of unpaid fees, including legal and administrative fees.

13. Traffic Violations & Fines

  • Renter’s Responsibility: The Renter is solely responsible for any traffic violations, fines, parking tickets, or summonses incurred during the rental period. This includes but is not limited to speeding tickets, illegal parking fines, toll violations, and any other traffic-related offenses.

  • Administrative Fee: If Xiao Qiang Holidays Sdn. Bhd. (XQ) is notified of any fines, tickets, or penalties after the rental period, the Renter will be charged the full amount of the fine plus an administrative fee of RM10 (plus 6% service tax) per violation to cover the processing and handling of the fine.

  • Payment and Liability: The Renter agrees to settle any fines or tickets immediately upon notification. Failure to pay fines promptly may result in additional charges, penalties, and possible legal action. The Renter will be responsible for any late fees, increased fines, or legal costs incurred due to non-payment.

  • Submission of Renter’s Details: In cases where the Renter fails to settle traffic fines or tickets, XQ reserves the right to submit the Renter’s personal details to the relevant authorities, which may lead to further legal consequences.

14. Cancellation & Refund Policy

  • 14-Day Cancellation Policy: Cancellations are allowed up to 14 days before the scheduled vehicle pick-up date. A RM15 cancellation fee will apply to all cancellations made within this period. Refunds will be processed within 5 working days and are based on GST+8 (Malaysian time).

  • Late Cancellations: Cancellations made less than 14 days before the scheduled pick-up date will not be eligible for a refund unless due to force majeure (e.g., natural disasters, emergencies). Date and time calculations for cancellations are based on GST+8 (Malaysian time).

  • No-Show Policy: In case of a no-show, where the Renter does not pick up the vehicle at the agreed time and location without prior cancellation, no refund will be provided, and the full rental fee will be charged.

  • Refund Processing: Refunds for eligible cancellations will be processed to the Renter's original payment method within 5 working days. XQ will not be responsible for any delays caused by the Renter’s bank or payment provider.

15. Terms and Conditions for Additional Second Driver

  • Additional Driver Requirement: The second driver must be added during the booking process. The Renter must indicate the need for an additional driver at the time of reservation.

  • Driver Documentation: It is the responsibility of the Renter to ensure that the additional driver meets the same requirements as the primary driver, including:

  • Age between 23 and 65 years.

  • Valid Malaysian driving license or an international driving permit with at least one year of driving experience.

  • Submission of a photocopy of the second driver’s license and ID upon vehicle pick-up.

  • Driver Capability: The Renter must ensure that the second driver is capable of driving the rented vehicle safely and legally. The Renter is liable for any actions, damages, or violations committed by the additional driver.

  • Charges: A charge of RM20 (plus 6% service tax) per rental applies for each additional driver. Payment for the additional driver must be made during the booking process.

  • Prohibited Drivers: Provision or newly qualified drivers are strictly prohibited from driving XQ vehicles. XQ reserves the right to decline any second driver who does not meet the specified criteria.

16. Parking Terms and Conditions

  • Responsibility for Parking: The Renter and any additional drivers are responsible for parking the vehicle in authorized, legal parking areas during the rental period. The Renter agrees to follow local parking regulations and ensure the vehicle is parked safely and securely.

  • Parking Violations: The Renter is responsible for any parking violations, fines, or penalties incurred during the rental period. XQ will charge the Renter for any parking fines plus an administrative fee of RM10 (plus 6% service tax) for processing each violation.

  • Towing and Impoundment: If the vehicle is towed, impounded, or otherwise seized due to improper parking or violation of local regulations, the Renter will be responsible for all associated fees, including but not limited to towing, storage, and administrative charges. The Renter must promptly inform XQ in case of impoundment and arrange for the vehicle’s release.

  • Vehicle Security: The Renter is responsible for securing the vehicle whenever it is parked, ensuring all windows are closed, doors are locked, and the keys are removed. XQ will not be liable for any theft, damage, or loss resulting from the Renter’s failure to secure the vehicle.

17. Fines, Tickets, and Penalties Terms and Conditions

  • Renter’s Responsibility: The Renter and any additional drivers are fully responsible for any fines, tickets, or penalties incurred during the rental period. This includes, but is not limited to:

  • Traffic violations (e.g., speeding, reckless driving).

  • Parking violations.

  • Toll violations or unpaid toll fees.

  • Any other infractions under local, state, or federal laws while using the rental vehicle.

  • Notification of Violations: If XQ is notified of any fines or tickets after the rental period, the Renter agrees to settle the charges immediately upon notification. The Renter’s credit card on file may be charged directly for the amount of the fine, plus applicable administrative fees.

  • Administrative Fee: An administrative handling fee of RM50 (plus 6% service tax) will be applied to each fine, ticket, or penalty processed by Xiao Qiang Holidays Sdn. Bhd. (XQ) to cover the costs of managing these violations.

  • Late or Unpaid Fines: Failure to pay fines promptly may result in additional charges, increased penalties, or legal action. The Renter is liable for any increased fines, interest, or legal costs due to delayed or unpaid fines.

  • Submission of Renter's Details: In cases where fines or penalties remain unsettled, XQ reserves the right to submit the Renter’s personal details to the relevant authorities for further enforcement, which may result in additional legal consequences for the Renter.

18. Governing Law & Dispute Resolution

  • Jurisdiction: These terms and conditions, and any disputes arising out of or related to the rental agreement, shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any disputes arising from this agreement.

  • Dispute Resolution: In the event of a dispute between the Renter and Xiao Qiang Holidays Sdn. Bhd. (XQ) concerning the rental agreement, both parties agree to first attempt to resolve the dispute amicably through negotiation. If a resolution cannot be reached within 30 days, the dispute may be escalated to a Malaysian court of competent jurisdiction.

  • Limitation of Claims: Any claims or actions against XQ arising out of this rental agreement must be filed within six (6) months from the date the rental period ends. XQ will not be liable for any claims made after this period.

  • Force Majeure: XQ shall not be held liable for any failure to provide services or any delays due to unforeseen circumstances beyond its control, including but not limited to natural disasters, weather conditions, strikes, wars, or government regulations. The Renter agrees that in such circumstances, XQ is not obligated to provide compensation or refunds.

19. Limitation of Liability & Force Majeure

  • Limitation of Liability: Xiao Qiang Holidays Sdn. Bhd. (XQ) shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the Renter's use of the vehicle, including but not limited to personal injury, death, property damage, loss of profits, or other losses. The Renter agrees to use the vehicle at their own risk and assumes full responsibility for any consequences arising from its use.

  • No Warranty: XQ makes no express or implied warranties regarding the vehicle’s fitness for a particular purpose, condition, or reliability. The vehicle is rented "as-is," and the Renter acknowledges that they have inspected the vehicle and accepted it in its current condition.

  • Vehicle Malfunction or Breakdown: In the event of mechanical failure or breakdown, XQ will endeavor to provide roadside assistance or a replacement vehicle if available. However, XQ shall not be held liable for any delays, inconvenience, loss of use, or additional costs incurred by the Renter during such an event. XQ will not provide compensation for lost time or travel disruptions resulting from vehicle malfunction.

  • Force Majeure: XQ shall not be responsible for any delays, cancellations, or inability to provide services due to unforeseen events beyond its reasonable control, including but not limited to natural disasters, weather conditions, accidents, government restrictions, strikes, war, or other emergencies ("Force Majeure Events"). In such cases:

  • XQ reserves the right to cancel or terminate the rental agreement without incurring any liability to the Renter.

  • XQ is not obligated to provide a refund, compensation, or alternative vehicle during the period of the Force Majeure Event.

  • Indemnification: The Renter agrees to indemnify and hold harmless XQ, its employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with the Renter’s use of the vehicle, violation of these terms, or any unlawful acts committed during the rental period.

  • Insurance Limitations: XQ's insurance coverage is limited to the terms specified in the rental agreement. The Renter acknowledges that certain types of damages, losses, or incidents may not be covered under XQ's insurance policy (e.g., using incorrect fuel, off-road driving, negligence). The Renter assumes full liability for such damages not covered by XQ's insurance.

  • Notice: In the event of any incident, accident, or unforeseen situation during the rental period, the Renter must notify XQ immediately and follow any instructions provided. Failure to report incidents promptly may result in the Renter being held fully liable for any damages or losses.
